EXCHANGE - RETURN - WARRANTY POLICY
CONTRACT TERMS - GENERAL CONDITIONS AND WEBSITE

At PARCHITA PACIFLORA S.A.S NIT 900245841-4, we work to offer you products with the highest standards of quality and satisfaction. If for any reason you need to manage an exchange or return, we provide you with the following conditions, in accordance with current regulations and our commercial policies.

1. Scope of Application

These policies apply to purchases made through our website www.parchita.com.co, as well as through our authorized digital channels. Conditions vary for national and international purchases, as indicated below.

2. Exchanges and returns for national purchases (Colombia)

If you made a purchase in Colombia, you can request an exchange of your item(s) within 30 calendar days after the order delivery, as reported by the carrier's tracking guide.

You can make the exchange in the following ways:

Visiting any of our physical stores in the country.

Contacting our WhatsApp line (+57 311 3796332) to manage the exchange directly from your home.

3. Warranty returns

If your product has manufacturing faults or defects, you may exercise the legal warranty within the following periods:

6 months for products such as handbags, wallets, and shoulder bags.

3 months for footwear.

In these cases, we will evaluate the product to verify the origin of the fault. If confirmed, we may opt for an item exchange, free repair, or money refund, as appropriate. The effectiveness of the warranty will proceed in accordance with the rules contained in Law 1480 of 2011 and Decree 735 of 2013.

Please note that the product loses its warranty in the following cases:

a. The instructions detailed on the packaging, manual, tag, and/or label, or generally those communicated by PARCHITA, have not been followed.
b. If the garment or item has had contact with deodorants, bleaches, detergents, or chemicals that cause deterioration to the fabrics.
c. If the product shows alteration, modification, or evidence of misuse.
d. The defect is solely a result of natural wear and tear from product use.

4. Conditions for accepting an exchange or return

To be accepted, the item must meet the following conditions:

Be in perfect condition: unused, unwashed, undamaged.

Have all its original tags.

Retain its original packaging and box.

Be accompanied by the exchange or return form, previously requested via email: info@parchita.com.co.

Important: If the package is returned without said form, it will be sent back to the customer's address, who will bear the costs of the new shipment.

We are not responsible for lost or damaged items in transit, so we recommend keeping the carrier's tracking number and properly securing the package.

In any case, PARCHITA reserves the right to approve or deny a return.

5. Exclusions

No exchanges or returns are accepted for international purchases.

Products purchased at a discount are considered "final sale" and are not eligible for returns or exchanges.

6. Term and procedure

Once the customer communicates their request and compliance with the conditions is verified, the customer service team will have up to 5 business days to confirm receipt of the request and coordinate the logistics for the exchange or return.

If the product is returned after 30 calendar days from its delivery, the package will be returned to the sender, who will be responsible for the return shipping costs.

7. Right of Withdrawal

In accordance with the right of withdrawal enshrined in Law 1480 of 2011, art. 47, the maximum period to exercise this right is five (5) business days from the delivery of the product. The product must be returned in the same conditions in which it was received.

The right of withdrawal does not apply in the following cases:

1. In contracts for the supply of goods manufactured according to consumer specifications or clearly personalized;
2. In contracts for the supply of goods that, by their nature, cannot be returned or may deteriorate or expire quickly;
3. In contracts for the acquisition of perishable goods;
4. In contracts for the acquisition of personal use goods.

In this case, PARCHITA will proceed to refund the consumer all amounts paid, without making any deductions or retentions. In any case, the refund to the consumer cannot exceed thirty (30) calendar days from the moment the right was exercised.

8. Payment Reversal.

Payment reversal may be requested if: the Consumer was a victim of fraud, the payment corresponds to an operation not requested by the Consumer, the purchased product was not received or does not match what was requested, it does not meet inherent characteristics, or the delivered product is defective. To request a payment reversal, the Consumer must file a complaint with PARCHITA. within five (5) business days following the date on which they became aware of the fraud, the unsolicited operation, or the problem with the purchased product. The complaint to the supplier of the good or service must contain at least:

1. Express statement of the reasons for the payment reversal request.
2. Indication of the reason supporting the request, which must correspond to one of those regulated in Decree 587 of 2016.
3. Amount for which the reversal is requested.
4. Identification of the bank account, credit card, or payment instrument to which the transaction was charged.

Likewise, the Consumer must notify the issuer of the electronic payment instrument within the same five (5) business day period that the consumer has to file the complaint with the Company, where they must indicate that they have fulfilled the obligation to return the goods when appropriate and provide proof or evidence of the complaint filed with the provider. The content of said notification must include at least the following:
1. Express statement of the reasons supporting the payment reversal request.
2. Indication of the reason supporting the request, which must correspond to one or some of those indicated in Decree 578 of 2016.
3. Amount for which the reversal is requested.
4. Identification of the transaction made, including number, date, and time, if applicable.
5. Identification of the bank account, credit card, or payment instrument to which the operation was charged.
6. Proof of the complaint filed with the Company.

Within the same period of five (5) business days, the Consumer must inform PARCHITA that the goods subject to reversal will be available for pickup under the same conditions and at the same location where they were received. PARCHITA will arrange the necessary logistics for the Consumer to return the product subject to reversal under the same conditions in which the Consumer received it.

PARCHITA must issue a certificate of filing said complaint, indicating the date and the cause supporting it.
In the event that the Consumer has requested a payment reversal and bad faith is determined on their part, the disputed transaction will be definitively charged to the consumer, and the Superintendence of Industry and Commerce may impose penalties of up to fifty (50) current legal monthly minimum wages.

In the event that the Consumer requesting the payment reversal is not the holder of the payment instrument, the request to the issuer must be submitted by the holder of the financial product.

When the payment corresponds to several products, the Consumer may request a partial reversal of the payment for those for which the request is made. In this case, the Consumer must clearly state which product and the amount for which the reversal is requested.

Once the complaint has been filed with PARCHITA and the reversal request has been submitted to the payment instrument issuer, the payment instrument issuer will have a period of fifteen (15) business days to effect the reversal, in accordance with the terms of Decree 587 of 2016.

9. Events Outside Our Control

We will not be liable for any failure or delay in fulfilling any of the obligations assumed when such failure or delay is due to events beyond our reasonable control ("Force Majeure Event").
Force Majeure Events shall include any act, event, omission, or accident beyond our reasonable control and, among others, the following:
a. Strikes, lockouts, or other industrial action.
b. Civil commotion, riot, invasion, terrorist threat or attack, war (declared or not), or threat or preparation for war.
c. Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster.
d. Inability to use trains, ships, aircraft, motor transport, or other means of public or private transportation.
e. Inability to use public or private telecommunication systems.
f. Acts, decrees, legislation, regulations, or restrictions of any government or public authority.

It will be understood that the obligations will be suspended during the period in which the Force Majeure Event continues, and we will have an extension in the term to fulfill said obligations for a period equal to the duration of the Force Majeure Event. We will use all reasonable means to end the Force Majeure Event or to find a solution that allows us to fulfill our obligations despite the Force Majeure Event.

10. Processing of Personal Data

The Consumer accepts the processing of their personal data provided to PARCHITA within the framework of the contractual relationship and declares that they are aware of the rights enshrined in Law 1581 of 2012, especially those to know, rectify, and update their personal data stored in the Company's databases and that they are aware of the Personal Data Processing Policy, which can be consulted at www.parchita.com.co, rights that may be exercised by email to: info@parchita.com.co. Likewise, they give their prior, express, and informed consent and authorize the Company to: a) collect, process, share, store, and archive the personal data that will be provided in the development of the sale through e-commerce and in general the commercial relationship with the Company; b) receive information in physical, audio, or electronic media such as email, text messages or data, through social networks, among others, about PARCHITA's products and commercial activities; c) be contacted for administrative, commercial, marketing, collection, and recovery purposes and in general any purpose related to the Company's economic and commercial activity; d) for the Company to transfer, transmit, and entrust the processing of personal data to Data Processors in the terms of Article 18 of Law 1581 of 2012 for the same purposes previously indicated for the Company or for marketing purposes.

11. Prevention of Money Laundering – Bribery – Corruption.


The Consumer declares that the money used to make purchases from the Company comes from their work or the development of their lawful businesses and, therefore, does not come from illicit activities such as money laundering, financing of terrorism, bribery, or corruption.

13. Additional observations

For changes in size, color, or reference, the customer may request the same product in another variation, subject to inventory availability.

The acceptance of any change is subject to the validation of the physical condition of the item in our warehouse.

14. Derisory price

· If on our website or social media, a price that can be considered derisory is erroneously set, by legal mandate, this will be considered as not agreed upon and the legal transaction of sale and purchase or any other will not be configured, so there will be no obligation on the part of the Company to honor the advertised price.

· PRICING POLICY
At www.parchita.com.co, our commitment is to offer convenience, service, and product availability online every day and of the best quality, with some limited-time merchandise offers and promotional prices. Merchandise offered online at www.parchita.com.co generally has the same price as merchandise offered in our PARCHITA PACIFLORA S.A.S. stores, although in some cases, there might be differences and changes without prior notice.

· COLORS: PARCHITA PACIFLORA S.A.S. has made an effort to display the colors of the garments as close to reality as possible. However, the color of the products appearing on screen may be subject to variations depending on the quality of your mobile device's or computer's monitor. In this regard, PARCHITA PACIFLORA S.A.S. cannot guarantee that the colors appearing on your mobile device or computer will faithfully match reality.

· TYPOGRAPHICAL ERRORS: In the event that a product on www.parchita.com.co appears with an incorrect price due to a typographical error or system error, www.parchita.com.co will have the right to deny or cancel any order placed for said products. If your credit card has already been charged for the purchase and your order is canceled, www.parchita.com.co will issue a credit to your credit or debit card account for the amount of the canceled price.

· PARCHITA PACIFLORA S.A.S. does not guarantee that the functions contained on the site will be uninterrupted or error-free, nor that all defects will be corrected, nor that the site or the server is free of viruses or other harmful components.

· PAYMENT METHODS. We accept electronic payments through Mercado Pago (debit and credit cards) via Wompi, ADDI, Sistecrédito or others. As these are third-party links, we apply the policies we have for them.

· 15% BIRTHDAY MONTH DISCOUNT. The 15% birthday discount benefit applies from May 1, 2024 to December 31, 2025 or until the company determines otherwise. The following are the conditions for the application of the benefit:
Single Discount: The birthday discount will be applied only once a month.
Unit Limit: The discount applies only to 3 units in your order.
Non-cumulative: It cannot be combined with other discounts, benefits or promotions during the month.
Identification Requirements: To obtain the benefit, you must present the ID of the person celebrating their birthday. The invoice must also be issued in the name of the cardholder.
Application: The discount applies in our physical stores and on our WhatsApp line. (Does not apply to purchases made directly through parchita.com.co).
The conditions and benefits of this discount may be unilaterally modified or canceled at any time by PARCHITA PACIFLORA S.A.S.

16. Applicable Legal Framework. This policy is governed by Colombian legislation, particularly by:

Law 1480 of 2011 (Consumer Statute) – articles 5, 6, 7, 11, 47 and 48.

Decree 587 of 2016 – Payment Reversal.

Law 527 of 1999 – validity of electronic operations. Law 1581 of 2012 – Personal Data Protection Law.
